Insurance Thoughts Related to 219/235 West 42nd Street
CITI'S TAKE
We certainly hope that the structural deformities that emerged today at
the property at 219/235 West 42nd Street can be safely (and quickly)
remediated. However, the situation creates an opportunity to
contemplate the potential exposures associated with a large, urban Insurance
property loss due to condemnation or collapse. See below for quick
thoughts. North America
Matthew HeimermannAC
If losses were confined to a structurally impaired building under construction, +1-404-443-4732
builders risk coverages would be triggered (direct loss to building/improvements, matthew.heimermann@citi.com
loss of rent, inability to occupy, cleanup and remediation, sunk development costs, Patrick Marshall
etc.) with losses dependent upon severity of outcome (remediation to collapse). +1-212-816-2651
Limits for a direct property loss would likely be at least equal to any lender financing patrick.c.marshall@citi.com
with other coverages sub-limited, but in addition to, the insured property loss. We
have not reviewed the policy associated with the property, but based on publicly
available information, the secured-financing associated with the building is at least
$520 million.
It is a big assumption to assume that any loss would simply be due to a contractor
error (or sub-contractor). It could also result from an engineering/design mistake
(which could impact E&O) or material failure (product or manufacturer liability). This
scenario would expose a different set of companies to loss (likely through
subrogation).
