Supreme Court reinforces Fed independence

An independent Fed

The ruling in the Trump v. Cook case protected Fed independence from the White House,

distinguishing the Fed from other independent agencies. In their decision, the majority

wrote that "Acceptance of the Government’s position would in effect transform the

Federal Reserve’s for-cause protection into at-will employment—an interpretive leap out

of step with the statute Congress enacted and our Nation’s tradition of central banking

protected from political interference."

The two major conclusions: First, it strongly protects the Federal Reserve's independence

by reaffirming that the President cannot remove a Federal Reserve Governor without

satisfying the Federal Reserve Act's "for cause" standard and the procedural protections

required by law. Second, it leaves intact (and even potentially reinforces) broader

presidential removal authority over other independent agencies.

What happened? President Trump attempted to remove Federal Reserve Governor Lisa

Cook, alleging mortgage-related misconduct. Cook argued that the allegations did not

constitute "for cause" removal under the Federal Reserve Act and that she had not been

afforded the procedural protections required by law. In a 5-4 decision, the Supreme Court

rejected the President's attempt to remove her.

Its decision treated the Federal Reserve as a unique institution rather than just another

independent agency. It emphasized the Fed's unique statutory structure, long fixed terms,

quasi-public institutional design, and longstanding historical role in conducting monetary

policy free from political interference. That distinction matters because, earlier this Term,
