HAPV/SulA/SAUD: Proposed bill could ease path for litigation - negative

A bill presented in BZ Chamber of Deputies proposes changes to the rules governing

the review of lawsuits involving requests for treatments not incorporated into SUS.

The proposal allows judges to grant preliminary injunctions without prior input from

NatJus in situations deemed urgent. Bill No. 2961/2026 establishes that NatJus

technical opinions will be advisory and non-binding, and must be considered

alongside other elements of the case. In urgent situations, the judge may grant

provisional relief based on a medical report and other available evidence.

UBS's view: We view this development as potentially negative for health plan

operators (HAPV/SulA/SAUD) as such measures—although initially proposed within

the scope of the public healthcare system (SUS)—could facilitate healthcare

litigation more broadly. If approved, the proposal could reduce procedural frictions

by allowing preliminary injunctions without prior technical review, potentially
