office Monday, expanding its probe into the alleged smuggling of restricted Nvidia

AI chips into China through SMCI servers. The investigation also reportedly involved

a search of six residences and three affiliated companies (including distributor

Albatron and data-center operator Chief Telecom) and summoning individuals

for questioning. The case still centers on document falsification, with SMCI not

charged as a company and reiterating it is cooperating. This news follows Taiwanese

authorities in May having detained individuals charged with smuggling SMCI

servers with NVDA chips to Hong Kong (via Japan).

While Supermicro does not appear to be directly involved in selling product to

China, the news again raises questions around the company's financial controls,

including vetting of NVDA shipments. And while we don't necessarily expect

repercussions from this latest set of events, we continue to remain concerned that

w/o a restructuring of SMCI's controls, operations, and processes, that financial and

compliance issues will remain an ongoing risk for the US server vendor. Bloomberg
