CNJ held this week the 8th Health Law Forum, a meeting focused on discussing

statements that serve as references for judicial decision-making in the sector. The

proposals under debate prompted opposition from social movements and public

defender’s offices. During the event, 74 patient associations signed a manifesto

calling for the rejection or revision of certain statements and for the preservation of

individualized case-by-case analysis in healthcare claims. They also advocated for

the inclusion of explicit safeguards for rare, ultra-rare, oncological, severe,

progressive, disabling diseases, and those lacking therapeutic alternatives. For the

supplementary health sector, the new guidelines approved during the Forum seek to

align judicial practices with the precedents established by the STF in its rulings on

healthcare-related litigation.

UBS's view: Litigation risks remain a key factor to monitor for health plan operators

(HAPV/SulA/SAUD). While the guidelines for supplementary health approved during

the Forum appear broadly aligned with the framework established by STF (which we
