• Crypto.com’s Nadex sued New York officials, arguing CEA/CFTC jurisdiction

preempts state gambling enforcement against federally regulated event-contract

• Kalshi, Nadex, and Polymarket’s U.S. exchange sued Kentucky to block a new

14.25% tax on prediction market transaction fees, arguing it is federally preempted (here)

• CFTC sued New Mexico in federal court after the state moved against Kalshi’s sports

event contracts, asserting the agency’s exclusive jurisdiction over federally regulated
